Terms of Service

These terms are the agreement between you and Frīday. By creating an account or using the app, you accept them. If you do not accept them, do not use Frīday.

Frīday is operated from California, United States. Contact: fridaycllctve@gmail.com. The Privacy Policy explains how your information is handled and is part of these terms.

Who can use Frīday

You must be at least 13 years old. If you are under 18, you may only use Frīday with the permission of a parent or guardian, who agrees to these terms on your behalf. Accounts identified as belonging to someone under 13 are deleted.

One person, one account. You are responsible for everything that happens on your account and for keeping your password to yourself. Tell Frīday immediately if you believe someone else has accessed it.

Usernames must not impersonate another person or organisation, and must not contain offensive terms. Frīday may reclaim a username that breaks this rule or that is inactive.

What Frīday is

Frīday lets you post songs, see songs your friends post, listen to short previews, and open or save those songs in Spotify or Apple Music. Frīday does not host music. Song details, artwork and preview audio come from Apple Music, Spotify and Deezer, and full playback happens in those services under their own terms. Frīday does not control those services and cannot promise they will keep working or keep supporting Frīday.

Your licence to use Frīday

Frīday gives you a personal, non-transferable licence to use the app on Apple devices that you own or control, as permitted by the App Store's usage rules. You may not copy, modify, distribute, sell, rent, reverse engineer or extract the source code of the app, or build anything that competes with it using it.

Your content

What you post stays yours. You keep all rights to your captions, comments, bio, profile picture and everything else you create.

So that Frīday can work, you give Frīday a worldwide, non-exclusive, royalty-free licence to store, reproduce, display and distribute your content within Frīday, and to make technical copies as needed to do that. This licence is only for running and improving the app. It ends when you delete the content or your account, except that copies may persist in backups for a limited time and in safety records as described in the Privacy Policy.

You are responsible for what you post. Only post content you have the right to post. Do not post other people's copyrighted material, private information, or anything you do not own or have permission to use.

If you send Frīday ideas or suggestions, Frīday may use them without any obligation to you.

Conduct and objectionable content

There is no tolerance for objectionable content or abusive users on Frīday. Do not post, send, upload or link to:

Do not attempt to break, overload, probe or gain unauthorised access to Frīday or its systems. Do not use bots, scrapers or other automated means to access Frīday or collect information from it. Do not try to get around a block, suspension or the content filters.

Reporting, blocking and enforcement

Any post or comment can be reported from the options on the content itself. Any account can be blocked, which hides their content from you and yours from them across the app.

Reports are reviewed and acted on within 24 hours. Content that breaks these terms is removed or hidden, and the accounts responsible may be suspended or deleted without warning. A suspended account can sign in but cannot post, comment, react, follow, save or be seen by other users.

Content is also checked automatically. A filter blocks certain words in posts, comments, usernames, display names and bios, and profile pictures are checked before they are stored. Content that fails a check is not saved.

Frīday may remove any content or suspend any account at its discretion where it reasonably believes these terms have been broken or other users are at risk. Serious cases may be reported to law enforcement.

If you believe your content was removed or your account was suspended in error, email fridaycllctve@gmail.com with your username and what happened.

Copyright complaints

Frīday respects the rights of creators. If you believe content on Frīday infringes your copyright, email fridaycllctve@gmail.com with:

  1. Your name, address and email
  2. A description of the work you say has been infringed
  3. Where on Frīday the content appears, with enough detail to find it
  4. A statement that you believe in good faith the use is not authorised by the owner, its agent or the law
  5. A statement, under penalty of perjury, that the information is accurate and that you are the owner or authorised to act for the owner
  6. Your physical or electronic signature

Content identified in a valid notice is removed, and the person who posted it is told. Accounts that repeatedly infringe are terminated.

Frīday's own content

The Frīday name, the F mark, the app's design, code and text are owned by Frīday and protected by law. These terms do not give you any right to use them except as needed to use the app. Song details, artwork and audio belong to their respective owners and are shown under licence from the services that supply them.

Third-party services

When you open or save a song, you leave Frīday and use Spotify, Apple Music or another service under that service's own terms. You agree to comply with those terms. Frīday is not responsible for those services, their availability, or how they handle your information.

Ending your account

You can delete your account at any time in Settings. Frīday may suspend or terminate your account if you break these terms, if required by law, or where necessary to protect other users or the service. When your account ends, your right to use Frīday ends, your content is removed as described in the Privacy Policy, and the sections of these terms that by their nature should survive, such as ownership, disclaimers and limitations of liability, continue to apply.

Changes to Frīday and these terms

Frīday is under active development. Features may change, be added or be removed, and the app may be suspended or discontinued. If these terms change, the date at the top changes with them. Significant changes are announced in the app before they take effect. Continuing to use Frīday after a change means you accept the updated terms.

No warranty

Frīday is provided as it is and as available, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Frīday does not promise that the app will be uninterrupted, error free, secure, or that any content will be accurate or remain available.

Limitation of liability

To the fullest extent the law allows, Frīday and its operator are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, use or goodwill, arising from or related to your use of Frīday, however caused. Total liability for all claims relating to Frīday is limited to one hundred United States dollars.

Some jurisdictions do not allow certain limitations, in which case these apply only as far as the law permits. Nothing in these terms limits liability that cannot be limited by law.

Your responsibility for your use

You agree to cover Frīday and its operator against claims, losses and reasonable legal costs arising from content you post, your breach of these terms, or your violation of anyone else's rights.

Content from other users

Frīday shows content created by other people. That content is theirs, not Frīday's, and Frīday does not endorse it or guarantee its accuracy or legality. If you see something that breaks these terms, report it.

Disputes and governing law

If you have a problem, email first. Most issues are resolved that way.

These terms are governed by the laws of the State of California, without regard to its conflict of law rules. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Orange County, California, and you consent to their jurisdiction.

Terms required by Apple

Frīday is distributed through the App Store. The following applies because of that.

General

These terms and the Privacy Policy are the entire agreement between you and Frīday about the app. If any part is found unenforceable, the rest still applies. If Frīday does not enforce a term, that is not a waiver of it. You may not transfer your rights under these terms; Frīday may transfer its rights to a successor, for example if the app is moved into a company.
